Purpose of the Job

Reporting to the CEO, the Legal Counsel will provide legal advice to executives, representation, guidance, and advise on Aecon’s on-going projects.

 Essential Functions and Responsibilities

General Legal:

  • Provide advice on a range of contractual issues during project execution and post-execution phases.
  • Identify core legal and commercial issues of importance to the Project Team and work closely with the Project Team to prepare negotiation positions and advocate said positions with counterparties.
  • Identify potential risks associated with projects and develop strategies to mitigate those risks.
  • Liaise between business unit / project leaders and external counsel on complex claims and litigation files.
  • Manage various project-related claims at different stages of the dispute resolution process, including dispute resolution board, adjudication, court and/or arbitration proceedings, and includes strategizing with project teams and instructing external counsel.
  • Actively manage and give instructions to external counsel on claims and litigation files.
  • Build strong partnerships and work collaboratively with senior project executives, external counsel, consultants and other stakeholders.

Reporting and Governance:

  • Research and preparation of reports, presentation materials and binders for executive management team may be required.
  • Summarizing, tracking, managing and regularly reporting on the contracting needs of the Company.
  • Draft policies and procedures relating to legal and corporate development function areas.

Knowledge, Skills, Abilities

  • Must be admitted to the Virgin Islands (VI) Bar (including, if applicable, pass the VI Bar Examination) and meet all qualifications set by the Committee of Bar Examiners to be a member of the Virgin Islands Bar Association. Due to the timing of admission (which may take several months or longer) the selected candidate could be admitted after being employed under the limited permission to practice as in-house counsel rule (VI Supreme Court Rule 202.1) initially on an interim basis.
  • You have demonstrated working experience/knowledge of commercial contract laws.
  • You have 3 or more years legal experience in a private practice or as in-house counsel specializing in contract review and negotiations.
  • You have demonstrated versatility with the ability to learn new business structures.
  • You have demonstrated verbal reasoning skills with the ability to interpret the precise definition of written documents such as contracts, legislation and case decisions.
  • You are an effective communicator, negotiator and consensus builder and can effectively influence without formal authority and work collaboratively with colleagues and divergent stakeholder positions.
